Our terms and conditions apply regardless of whether a contract is made verbally, through our app, or in writing. The hirer assumes responsibility for the actions and decisions of all passengers on board, including any additional costs incurred while fulfilling the contract, irrespective of whether they are traveling with the party.
Animals/Pets:
Caged or Uncaged Animals will not be carried on any vehicle unless stated when booking, please note there may be a charge for “Uncaged Animals” excluding guide dogs & assistance dogs.
Provision Of Vehicle/ Use & Capacity:
Drivers will not carry any extra passengers over the seating capacity.
The Company may provide a larger vehicle than the size hired at no additional charge. The company reserves the right to send a replacement vehicle where available to cover the hire in times of breakdown or emergency or will assist in finding local services to aid with onward travel where possible. The company reserves the right to hire another Operator to cover the hire.
The hirer cannot assume the use of the vehicle between outward & return journeys, nor that it will remain at the destination for the hirer’s use unless this has been agreed with The Company. The Company reserves the right to levy additional charges for additional mileage or time to that agreed. The charges will be pro rata & in accordance with booking confirmation.
Routes:
The route used locally in Torbay will be shortest route available unless otherwise agreed between the driver and customer. This can be due circumstances beyond the driver’s control. This can include but not limited to Highway Road Works, Road Traffic Collisions, Closed Roads etc.
Tariff/ Charges/ Waiting Time:
For local work within Torbay, all of our jobs are calculated using the Torbay Hackney Tariff which can be found: Hackney Carriage fares - Torbay Council.
Any out of area work, airports/ seaports are pre-agreed rates.
It’s the hirer's responsibility to account for all passengers upon arrival of the vehicle for the booking. Any delay in excess of 5 minutes may incur a waiting charge.
If the hirer does not contact the driver within 5 minutes of the booking/ driver arriving at the address, the driver reserves the right to pull away from the booking.
All estimated prices are given in good faith at time of booking, we use real time traffic to calculate and estimate fares. The final fare may be subject to variants on the journey such as traffic delays, passenger numbers etc.
Soiling/Fouling:
In the event of any soiling or fouling in any of our vehicles a charge of £75.00 will be made for cleaning costs and downtime. This charge must be paid at the time of the occurrence.
Breakdown/Delay:
The Company gives advice on journey times in good faith but does not guarantee the completion of a journey at a specific time and will NOT be liable for inconvenience or loss caused by breakdown or delay (traffic or otherwise).
Property:
All vehicles hired are subject to restrictions on carrying luggage for statutory safety reasons & the driver shall be the sole judge as to whether & to what extent passengers’ property is carried. The Company will not accept liability for any damage or loss of any property, which belongs to any passengers and is left on a vehicle. Any articles of found property recovered from a vehicle will be held at the office. It is strongly recommended that personal insurance is taken out for luggage and valuables. Please contact the office via the website if you have lost anything in one of our vehicles providing as much information as possible for us to identify the vehicle and item.
Passenger Behaviour & Conduct:
The driver is responsible for the safety of the vehicle. Any passengers whose conduct is in breach of statutory regulations and the driver considers them unfit to travel (for example being intoxicated or abusive) will be removed on the driver’s sole discretion and authority. If the driver considers any passenger to be behaving in such a way as may put other passengers/the driver and/or the vehicle or its contents at risk, he/she may refuse to continue the journey. The hirer will be responsible for all damages caused to the vehicle by passengers during the hiring.
Safety:
All passengers must always wear the provided seat belts whilst the vehicle is in motion. The company will not accept any liability for injuries caused in whatever manner whilst travelling on board the vehicle due to failure to wear the provided seat belt.
Complaints:
All complaints must be made within 7 days of the date of hire in writing to: info@bay.taxi
No compensation will be paid out from the company for any reason.
Please note all drivers work in a self employed capacity and whilst we will handle any complaints at the highest severity and do our upmost to resolve, we may not be able to and if that is the case we may refer or direct you to address your complaint to Torbay Council Licensing: Taxi complaints in Torbay - Torbay Council
Notices:
No notice or posters of any sort are to be displayed on or in any vehicle without prior consent of The Company.
Food/ Drink/ Smoking & Vaping:
Under no circumstances may food or drink can be consumed within our vehicles and no open containers to be carried within the vehicles. *This includes but not limited to alcoholic drinks.
All Vehicles are non-smoking/ non-vaping.
Please note if any of these are not followed a spoilage charge may be applied.
Airport/ Seaport Transfers:
As well above terms and conditions the below apply when booking for Airport/Seaport Transfers.
The hirer is solely responsible for checking the booking correspondence (usually through email/text) for accuracy and completeness. Any errors must be notified to the company as soon as possible. Amendments to bookings can only be considered upon confirmation in writing from the customer. If the hirer does not receive an updated booking confirmation from the company, then the hirer must assume that the existing booking has not been amended. It is the hirers responsibility that all trip details are complete and correct. Never should a verbal amendment to any booking be considered as a confirmation that the existing booking has been updated.
Unless the hirer has advised of a particular route or places to be passed on-route, the route will be at the discretion of the company and/or the driver. The vehicle will depart at the times agreed by the hirer, and it’s the responsibility of the hirer to account for all passengers at those times. The company will not accept liability for any losses incurred by the passengers who fail to follow agreed schedule between hirer and company.
In the event of an emergency or an action by the hirer to vary the agreed conditions, the company may return all monies paid and without further liability and cancel the contract.
All passengers are recommended to obtain travel insurance including cover for any specific items, the company’s liability is limited.
